At the Monday, May 2 In-Person Regular Meeting in the Community Center, Councilmembers proclaimed May 1-7 as Hurricane Preparedness Week and Public Service Recognition Week; proclaimed May 15-21 as National Police Week; recognized Thurgood Marshall High School Mighty Stampede Band and Band Director Darwin Lewis for their “Superior” UIL Rating; and recognized Mike Harris for providing outstanding customer service. Here is a rundown of all Council actions at the meeting:

Staff Reports

  1. Economic Development Director Aubrey Nettles presented a proposed Restaurant Incentive Program for the Texas Parkway Cartwright Road Corridor. 

Consent Agenda

  1. Approved an ordinance (7-0) on the second and final reading to amend Chapter 2, Administration, of the Missouri City Code; amending the terms for the Ethics Commission.
  2. Reviewed and accepted (7-0) the Quarterly Investment Report for the quarter that ended on March 31, 2022.
  3. Authorized the City Manager (7-0) to execute a contract (IFB 22-315) with GCI Solutions, LLC; Brooks Concrete, Inc.; and Greenscapes Six, LLC for sidewalk construction and repair services in the amount not to exceed $750,000 with each vendor over a three-year period.
  4. Authorized the City Manager (7-0) to execute a contract (IFB 22-320) with DXI Industries, Inc. for the purchase of Sodium Hypochlorite 10% (Bleach) for use at the Mustang Bayou Wastewater Treatment Plant in the amount not to exceed $150,000 over a two-year period.
  5. Approved an ordinance (7-0) on the second and final reading to rezone land contained within a 6.85-acre tract from LC-2, local retail district to LC-3, retail district. A portion of the land is currently zoned LC-2, local retail district and the remaining portion is zoned LC-3, retail district. The site is located north and east of Rothwell Street, south and east of the intersection of 5th Street and Independence Boulevard and west of the Lexington Place residential subdivision.
  6. Approved an ordinance (7-0) on the second and final reading to rezone an approximate 0.56-acre tract of land from SD, Suburban District to LC-2, local retail district; and to the extent such zoning deviates from the Future Land Use and Character map of the Comprehensive Plan, to provide for an amendment therefrom. The subject site is located south of Highway 6, east of Trammel Fresno Road, and west of Oakwick Forest Drive. The subject site is adjacent to Oakwick Forest Estates subdivision and a new shopping center having an address of 9720 Highway 6.
  7. Authorized the City Manager (6-1) to execute a contract with Construction Masters of Houston, Inc. for the renovation of City Hall Complex Facilities, in an amount not to exceed $147,099.
  8. Authorized the City Manager (7-0) to execute a contract (IFB 22-321) with PB&J Pavement Marking, Inc. for pavement marking services in the amount not to exceed $400,000 per year over a three-year period.

Public Hearings & Related Actions

  1. Zoning Public Hearings & Ordinances
    1. Held a public hearing to receive comments for or against a request to rezone an approximate 24.45-acres tract of land to PD, Planned Development District to allow for a mixed-use development to include retail, commercial, and residential uses; and to the extent such zoning deviates from the Future Land Use and Character map of the Comprehensive Plan, to provide for an amendment therefrom. The subject site is located south of Highway 6, north and west of Fort Bend Parkway, and east of Oakwick Forest Drive. 
  1. Public Hearings & Related Actions
    1. Held a public hearing to receive comments for or against a request to adopt an ordinance continuing Article VII of Chapter 74 of the Missouri City Code, continuing the rules and regulations pertaining to the standards of care for certain elementary-age recreation programs operated by the City of Missouri City.
    2. Approved an ordinance (7-0) on the first of two readings to continue the rules and regulations pertaining to the standards of care for certain elementary-age recreation programs operated by the City of Missouri City.

Ordinances

  1. Approved an ordinance (4-3; At-Large Position #1 Councilmember Vashaundra Edwards, At-Large Position #2 Councilmember Lynn Clouser and District A Councilmember Monica Riley voted against) on the second and final reading to establish new city council districts by adopting Map C-Revised.

Resolutions

  1. Approved a resolution (7-0) finding that CenterPoint Energy Houston Electric, LLC’s application for approval to amend its distribution cost recovery factor to increase distribution rates within Missouri City should be denied; finding that the City’s reasonable rate case expenses shall be reimbursed by CenterPoint Energy Houston Electric, LLC.
  2. Approved a resolution (6-1) authorizing the waiver of fees to use a City park for the Snowdrop Foundation Ultra 55 Endurance Race; providing for repeal; providing for severability; and making certain findings relating thereto.

Closed Executive Session

  1. Texas Government Code, Section 551.071 – Consultation with attorney to seek or receive legal advice regarding pending or contemplated litigation, a settlement offer, or on a matter in which the duty of the attorney to the City under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with the Texas Open Meetings Act: (i) Pastor Jeremiah Asomugha (Miracle City Church) v. Missouri City (Harris County Cause Number 202202299 in the 281st District Court of Harris County); and (ii) Missouri City Gifts, Inc. v. the City of Missouri City, Texas (Case No. 4:22-CV-00936 in the United States District Court for the Southern District of Texas Houston Division).
  2. Texas Government Code, Section 551.074 – Deliberations concerning the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee: the City Manager. 

Reconvene

  1. The City Council unanimously voted (7-0) to terminate Charles Jackson’s City Manager contract with cause. 
  2. The City Council voted (6-1) to name Acting City Manager Sedrick Cole as the Interim City Manager for up to 30 days with a 20 percent salary increase.
  3. The City Council voted (6-1) to authorize Interim City Manager to utilize GovHR to recruit an Interim City Manager along with Human Resources.
  4. The City Council unanimously voted (7-0) to authorize the current Interim City Manager to utilize GovHR to move forward with the search for a new City Manager, along with Human Resources, pursuant to the contract that’s already in place.
